.....RESPONDENTS

WHEREAS the Petitioner above named through his Advocate Sri S.R.Sanku, presented this writ petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue a Writ Or order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd respondent in dispossessing the Petitioner from her piece of land admeasuring Ac.2.64 cents of Wet land in Sy.No.214/3 of Jaddangi Village, Rajavommangi Mandal, East Godavari District by issuing D-form patta in favour of the 4th respondent on 7-1-2007 within 24 hours of the orders in CMA No.49 of 2005 dated 06-01-2007 of the 1st respondent, as illegal, arbitrary and contrary to rule 7(4) of the A.P.Scheduled Areas Land Transfer Rules 1969, diametrically opposite to the law declared by this Hon'ble Court in the case of Mamillapalli China Koteswara Rao and others reported in 2005(3) ALT 88 and violative of principles of natural justice and Article 21 of the Constitution of India and it is further consequentially prayed that this Hon'ble Court may be pleased to direct the respondent No.1 to 3 to forthwith restore the said land to the petitioner, duly paying her compensation for illegal dispossession of her land and the loss she has been suffering by duly canceling the D-Form patta issued by the 3rd respondent to the 4th respondent in Ref.(B)/3/2007 dated 7-1-2007.

 

AND WHEREAS the High Court upon perusing the petition and the affidavit filed herein and upon hearing the arguments of Sri S.R.SANKU, Advocate for the Petitioner and the Government Pleader for Social Welfare, who takes notice and seeks time to file counter in the meantime, directed issue of notice to the Respondents herein returnable in three weeks, to show cause as to why this writ petition should not be admitted in the circumstances set out in the petition and the affidavit filed in Writ Petition.
